Exceptional Circumstance

As per Miyagi Pty Ltd’s terms and conditions,
If, as a result of highly detailed medical advice (which is confirmed in writing), it is no longer advisable for you to continue receiving our services under our approved medical excluded conditions, and we agree that you should not continue (i.e. “exceptional circumstances” occur), then you should discuss with us terminating these arrangements. In such exceptional circumstances, but not otherwise, we will normally refund the upfront fee, less reasonable reimbursement to us for the services already provided to you (if any) or for the reasonable reimbursement of costs associated with running our business.

Therefore, by signing Miyagi Pty Ltd’s terms and conditions, you hereby acknowledge that you have provided a truthful and accurate declaration of all known medical conditions to the best of your knowledge. Miyagi Pty Ltd requires individuals to disclose all relevant medical information to ensure their safety and well-being during their program and to prevent any potential risks that may arise due to undisclosed medical conditions.

If confirmed in writing by a General Practitioner or Medical Specialist (including a Cardiologist, Gastroenterologist, Nephrologist, Psychologist, Oncologist, or Surgeon) that the client meets any of the following circumstances, will a client be eligible for discussing the termination of their agreement.

Exceptional circumstances include:

• • Stage 3 and 4 Liver Disease (including Liver Cirrhosis)
  • Active Anorexia Nervosa or Bulimia Nervosa
  • Stage 4 and 5 Kidney Disease, or anyone undertaking Dialysis
  • All active cancers
  • Bariatric Surgery within the last two years
  • Currently on the waitlist for an organ transplant
  • Diagnosed with Inflammatory Bowel Disease (IBD) and have had major surgery, e.g. ileostomy, or hospitalised in the last six months
  • Anyone who is under the age of 18 years old or over the age of 80 years old

Please note: If a condition or circumstance does not fall within our criteria, we are happy to discuss options to continue supporting you in our Miyagi Pty Ltd programs.
