Terms & Conditions

Miyagi Health USA, a Delaware company, and its affiliates and subsidiaries (“Miyagi”, “we”, “us”, “our”) Terms and Conditions (“Terms”) apply to your (“User”, “you”, “your”) use of Miyagi’s Services (the “Services”) you have accessed through our software application (the “App”), through a desktop, laptop, or mobile device. 

By signing with Miyagi Health USA, we and you agree to be bound as follows:

You’re committing to a 26-week minimum service period (the “contract period”) which constitutes 1 payment (the “establishment fee”) to be paid in full upon joining.

1 – The Services we provide you include: an individualized health plan; one-on-one and group facilitated coaching aimed at ensuring you meet your personal health goals; and access to our private support group, the Miyagi App, and program resources.

2 – Your 26 week minimum service period (the “contract period”) will commence upon signing this e-document. You agree that during the minimum service period, you cannot suspend, pause, or place your program or payments on hold.

3 – Other than in exceptional circumstances, no part of the upfront fee shall be refundable, even if you do not wish to continue to receive the services for the full contract period. This means there is no ‘cooling off period’ or ‘change of mind’ refund available to you or to cancel before your minimum term. 

4 – A third party provider may be able to assist you in paying the establishment fee. 

5 – Upon completion of the 26-week minimum service period, unless otherwise advised by you in writing, Miyagi Health USA will automatically enroll you into the ‘Lifestyle Program,’ which has a rolling 30-day minimum service period. Monthly debits will continue from your nominated credit card for uninterrupted access to our services. This will occur without further notice, irrespective of your participation or utilization of the services. To terminate your ongoing services, a written notice must be sent to customersupport@miyagi.coach, and a 30-day notice period applies.

6 – Once you’re enrolled into the ‘Lifestyle Program’, if you choose to suspend, pause, or place your membership or payments on hold, to re-enter the program you will need to repay the establishment fee in full before being allowed back in.

7 – Deposits made to secure products and services are non-refundable. Once a deposit is submitted and acknowledged by Miyagi Health USA, it is considered final and will not be refunded under any circumstances.

8 – The services will be delivered to you by our allied healthcare team who are registered with the appropriate governing bodies and are fully covered by professional indemnity insurances. Throughout the contract period, our staff will be committing time and resources to providing the services to you that fall within the program deliverables.

9 – You acknowledge that we will be relying on the accuracy and honesty of your responses to our requests for details of your personal circumstances and medical history to provide the services to you.

10 – Our staff can only provide advice to you within their scope of practice. Nothing we suggest or recommend is to be taken by you as medical advice, nor should our advice be placed ahead of any medical advice you have received. If you are unsure about anything, you must consult your doctor.

11 – If, as a result of highly detailed medical advice it is no longer advisable for you to continue receiving our services due to exceptional circumstances confirmed in writing by a licensed physician, and we agree that you should not continue (ie “exceptional circumstances” occur), then you should discuss with us terminating these arrangements. In such exceptional circumstances, but not otherwise, we will normally refund the upfront fee, less reasonable reimbursement to us for the services already provided to you (if any) or for the reasonable reimbursement of costs associated with running our business.

12 – Except as otherwise provided under federal and state consumer protection laws, you accept that participation in the program is entirely at your own risk, and you agree to hold us or any of our staff harmless for any injury or illness sustained.

13 – You acknowledge that any material provided to you that is not in the public domain is our intellectual property and may not be dealt with by you without our consent.

14 – At the end of the minimum service period, if you decide not to continue, you acknowledge that your access to the Miyagi App, private support group and all other digital services will cease, unless you purchase additional services.

15 – Any of your personal information provided to us will be dealt with in accordance with our privacy policy.

16 – These Terms and Conditions are private and confidential. They are provided to you for your personal use only and must not be republished, distributed, or shared with any third party without our express written consent.

By agreeing to these Terms & Conditions, you acknowledge that you have read our Additional Terms and agree that you shall be bound by these Terms & Conditions and the Additional Terms.
